The organizer of the promotion "BASIC PROMO" ("Promotion") is THE ODDER SIDE LIMITED LIABILITY COMPANY, located in Warsaw, at ul. Widok 10 lok. 3A, 00-023 Warsaw, registered by the District Court for the Capital City of Warsaw in Warsaw, XIV Economic Department of the National Court Register, KRS 0000983656, NIP 7010439296, REGON 147420946, with a share capital of: 5,000.00 EUR. ("Organizer").
The promotion lasts from August 8, 2024, to August 22, 2024, or until stocks are exhausted (whichever occurs first).
The content of the Promotion regulations is available on the Organizer's online store page at REGULATIONS FOR THE PROMOTION ("Online Store") and at the Organizer's headquarters.
All phrases written in capital letters have the same meaning as assigned to them by the regulations of the Online Store available at the link https://theodderside.com/pages/regulamin, unless the Promotion regulations state otherwise.
§ 2. CONDITIONS OF PARTICIPATION IN THE PROMOTION
The promotion includes the following products available in the Online Store: T-SHIRT V-BACK ORGANIC and LONGSLEEVE V-BACK ORGANIC.
When placing an Order in the Online Store, if at least 2 (two) v-backs are purchased (i.e., two T-SHIRTS V-BACK ORGANIC or two LONGSLEEVE V-BACK ORGANIC or one T-SHIRT V-BACK ORGANIC and one LONGSLEEVE V-BACK ORGANIC), the Customer can take advantage of the promotion and add to their Order BODY EMI ORGANIC ("Emi") or BODY SOPHIE ORGANIC ("Sophie") for 1.00 EUR (one euro, 00/100) (Sophie and Emi together referred to as "Promotional Product").
The Customer may participate in the Promotion any number of times, provided that the conditions specified in paragraph 2 above are met each time.
Participation in the Promotion implies acceptance of the Promotion regulations and the Online Store regulations.
The regular price of Emi and Sophie is listed in the Online Store.
The Customer cannot receive a monetary or material equivalent in exchange for Emi or Sophie.
In the event of a return of part of the Order, resulting in the Order not meeting the conditions referred to in paragraph 2 above, or the return of the entire Order (i.e., exercising the right to withdraw from the contract), the Customer is obliged to return the Promotional Product.
§ 3. COMPLAINTS
Complaints concerning the Promotion can be submitted via email: hello@theodderside.com or addresses indicated in the Online Store regulations (point X of the Online Store regulations). The content of the complaint should briefly describe the circumstances justifying its submission.
Complaints concerning the Promotion will be considered within 14 days from the day they are received by the Organizer. The provisions of the Promotion regulations in no way limit the rights to file complaints or pursue claims available to customers under generally applicable legal provisions.
The Organizer reserves the right to end the Promotion at any time during its duration, without giving reasons.
The Organizer reserves the right to change the Promotion regulations. Any changes to the Promotion regulations will be effective from the day they are announced.
§ 4. DATA PROTECTION
Personal data of Customers are processed for the purpose of conducting the Promotion. Personal data of Customers who have filed a complaint concerning the Promotion are processed for the purpose of considering their complaint.
The data controller for the Customers' personal data is the Organizer, i.e., The Odder Side Limited Liability Company, located in Warsaw. The processing of personal data is in accordance with legal regulations, especially in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation). Detailed information regarding the processing of personal data, including information on the rights available to the Customer, is contained in the privacy policy posted on the Organizer's website at https://theodderside.com/pages/polityka-prywatnosci-z-dnia-16-05-2023.
§ 5. FINAL PROVISIONS
In matters not regulated by the Promotion regulations, the provisions of the Online Store regulations and applicable legal provisions apply, in particular the Civil Code.
Promotional materials relating to the Promotion are for informational purposes only. Only the provisions of the Promotion regulations and the Online Store regulations have legal binding force.
The regulations are effective from August 8, 2024.
In justified cases, the Organizer may change the Promotion regulations, about which it will promptly inform Users by publishing the consolidated text of the Promotion regulations in the Online Store. Changes to the Promotion regulations do not affect contracts concluded within the Promotion before the publication of the change information.
